Premarital sex is not an offence: SC ???

In an observation that would mightily cheer liberals, the Supreme Court said on Tuesday that live-in relationships and pre-marital sex could not be considered offences.

“When two adult people want to live together what is the offence?” asked a three judge bench comprising of Chief Justice K.G. Balakrishnan, and Justices Deepak Verma and B.S. Chauhan. “Living together is not an offence. It cannot be an offence.”

The court pointed out that even Lord Krishna and Radha had lived together according to mythology.

The judges made the observations while reserving judgment on a special leave petiton filed by Tamil actress Khushboo seeking to quash 22 criminal cases filed against her in Tamil Nadu for allegedly endorsing pre-maritial sex in interviews to various magazines in 2005.

Khushboo was present during the entire hearing and was seated in the first row, dressed immaculately in an orange salwar with a green dupatta wrapped casually and her goggles fixed on her forehead.

The judges asked a battery of lawyers appearing for the complainants what was the offence the actress committed while expressing such views.

The lawyers argued that her comments would mislead young people and lead to decay in moral values. They said that if prominent people make such statements, it would create chaos in society.

“People of Tamil Nadu were worshipping her as Goddess but this is what they got out of her worship,” said a lawyer, but the court was not impressed.

“Please tell us what is the offence and under which section,” said the court. “Living together is a right to life.”

The judges also pointed out that views expressed by Khushboo were personal and did not concern others. In a democratic country, people had the right to express views, they said.

“How does it concern you?” they asked. “We are not bothered. At the most it is a personal view. How is it an offence? Under which provision of the law?”

“You have to establish a cognizable offence,” said the judges. “That this may have affected the public morality that is your view but we are only concerned with the law.”

The apex court further asked the complainants to produce evidence to show if any young girls had eloped after the actress gave the interview.

“How many homes have been affected?” the judges asked, and enquired whether the complainants had daughters. When the lawyers replied in the negative, they shot back, “Then how are you adversely affected?”

Meanwhile, Khushboo’s lawyer, Ms Pinkey Anand, alleged that her client had been targeted for political reasons. Even her clarification on the issue was not published in proper perspective by the media, said the counsel.

” She had not made any reference about Tamil Nadu women but this part was not published,” Ms Anand said.

The lawyer added that there was nothing wrong in Khushboo’s statement. “Indian society should be liberated from the thinking that a women should be a virgin (at the time of marriage),” she argued.

Khusboo had approached the apex court after the Madras High Court in 2008 dismissed her plea for quashing the criminal cases.

“KHOLO” – The Favorite demand of Akshay Kumar

What do you make of high profile lyricist Javed Akhtar endorsing Jaypee Cement? Om Puri for another brand of cement in the back drop of high rise buildings and airplane ?

The spectacle of celebrities in brazen cynical self-devaluation has had a certain undeniable force over the years. We have Big B selling some cool cool thanda thanda liquid fat. Should I consider him an exception owing to his growing age and believing myself charitable ?

It’s a mad mad world of creativity…..
For some, their profession hangs heavy round their necks and some are cut out for their jobs. We have Aamir Khan who is synonymous with Perfection we have Salman Khan who is famous for his brawn and generosity; we have Shahrukh Khan who has a Midas touch in every touch, of course with the exception of Knight Riders. But the one who flies at the tangent is our ‘Smooth Operator’ Akshay Kumar ‘The Machismo’ from Parantha Gali. Like his worthy colleagues of silver screen Akshay Kumar has several ‘worthy to ignore’ add campaigns to his credit. However, three of his performances have some very similar interesting story line and it can be put in one simple double-connotation word KHOLO (open up). This word seems to signify his brand of ‘Machoism’.

I have no hesitation in accepting that he is a man who has definitely changed the rules of the game. You can say he has almost rewritten it on his own terms. He had pushed the borders of decency to father horizons of hitherto somber add world. I’m not talking of condom adds or sweet Puja Bedi.

If the memory of the public is not worn out, let them remember the day when star Akshya Kumar was honored by President of India with the prestigious Padma award. On the same glorious day he was also seen in an obscene gesture at Lakme Fashion Show where he got buttons of his pants opened by his wife Twinkle. How unabashedly he pampers his wife to de-zip his pant before the spell bound and shocked audience ? Many law suits followed that adventure and he and his wife got easy escape from law.

Recently Akshay replaced Salman as Dollar innerwear brand ambassador. The add has its usual shor-sharaba and it begins with a shot where he asks 26 number bus to some punky funky gangsters and subdues them in a jiffy (an old Engglish theme which in different avatars have been repeated in Hindi films). In the next shot he becomes an embodiment of virtue and modesty and reminds a damsel in distress about ‘Aapka button khula hai !” The KHULA (open up or open down) word again is the climax of the theme.

And lo we have ‘Thumps Up – the tastes of thunder !” Again we find our macho man dangling in the air with a senorita comfortably ensconced in his lap on the plank of the suspender. The poor devil-may-care gymnast discusses about the very personal chase and follow-up query which again ends at a benign request – KHOLO ! This time again the same word come handy and it is about the bottle of Thumps Up ! Any comfort ?
After the luke-warm success of ‘Singh Is King’ he continues to appeal us with action, delight and comedy on screen which are turning out to be the damp squib.

His journey from KHOLO to KHULA and back to KHOLO might be an interesting coincidence of his life.

On a serious note – A recent survey conducted jointly by IMRB and i-Pan of over 2000 respondents, across 12 cities ( small and big metros) found that 86 percent of those interviewed admitted that the ad they most remembered had a celebrity. Ironically, only 3 percent said it influenced their buying decision. The IMRB study found that “more than the celebrity pull, factors like quality, price and experience ultimately drove consumers purchasing pattern.” Only 22% of this sample believes that the celebrities actually use the products endorsed.

Once upon a time there was a name with several nicknames to her credit – the ace Indian tennis player, tennis sensation of India, the tennis star of India, youth icon of India or the lone Indian flag bearer at world tennis circuit – Sania Mirza.

THE TUMULTUOUS brouhaha of Indian Premier League took its toll on one individual’s great success story. In the commercially triggered cosmetic euphoria media criminally ignored and reduced the greatest achievement of the finest Indian woman badminton player Saina Nehwal into a damp squib. The reticent, sober and wonderful player was content with the rationed laurels and the left-handed compliments she got. She didn’t complain. The country failed to exult the way it should. Silently but gracefully Saina climbed to the top fifth position in the world badminton ranking. The new feather in her cap is followed by her spectacular stellar performance at the All England Championship where she reached the semifinal.

Perhaps ,she was short of the glamour quotient!

She was a rage in India when she reached the forth round of US Open in 2005. She is the only Indian woman to reach the forth round of any Grand Slam event. She is also the first Indian to get into the top 50 WTA (Women’s Tennis Association) rankings. High rankings of her career till date are like 27 in singles and 18 in doubles.

In those memorable days each tournament was a new stepping stone towards the new triumphs. She remained unfazed when most of the Mullahs, with the exception of Mirza Mohammed Athar of Lucknow, hounded her for her dress or even for her act of playing tennis. But in due course of time, her lack of experience or guidance exposed her feet of clay. She allowed the brand Sania to take over the tennis player Sania. Ultimately she broke down.

Then came another mile stone of her life. Sania’s father announced that Sania Mirza engaged to her childhood companion and business scholar from their hometown Hyderabad. Even before the two got engaged, questions were asked whether Sohrab Mirza could cope with the demands of being life-partner to a widely-travelled, hugely-popular athlete. Unfortunately, the worst fears of the cynics proved true and premonitions persisted and won. Her father Imran, who coaches Sania and manages her career, called off his daughter’s engagement to Mohammed Sohrab Mirza. Sania did put up a bold face in the adversity and categorically refused to get into the why and what of the matter. She confirmed her engagement was off. “We were friends for half a decade, but found ourselves incompatible during our engagement period. I wish Sohrab the best in life.” Since then she hasn’t taken the break-up well as her results on court show. But with hard work and luck we hope and pray that Sania will definitely be the top tennis player in world one day.

Someone has commented – Sania Mirza hasn’t had the best of starts to the 2010 season – on and off court. A broken service game is one thing, but a broken engagement or a broken heart, is quite another.

I believe that like the several snide criticism of mullahs and other persistent controversies haunting Sania, she would have been able to surmount the challenges. It were not the natural calamities or a bad engagement that pushed down Sania; it were the pressures of brand SANIA that proved he Waterloo; it was super stardom which consumed Sania.

Here is something that own new deity Saina Nehwal has to learn from the odyssey of poor Saniya. The new glittering star of badminton much know that the sumptuous blend of celebrity endorsements, featured appearances, adoring fans, fame and money are a cocktail too heady for tender young minds to bear.

Everyone can’t be a Sachin Tandulkar.

Batla House encounter

Without raising any suspicions for the intentions of law enforcement authorities, a number of well-meaning commentators and politicians have also expressed concern over the Batla House encounterin Jamia Nagar.

EVER SINCE Batla House encounter in New Delhi’s Jamia Nagar, critics have been claiming that the two men killed by the police were innocent students, not Indian Mujahideen terrorists.

Without raising any suspicions for the intentions of law enforcement authorities, a number of well-meaning commentators and politicians have also expressed concern over the encounter. The jinn of encounter is failing to die. The recent postmortem reports of the two suspected militants killed in the encounter have been obtained by Jamia Millia Islamia final year student Afroz Alam Sahil from National Human Rights Commission and forensic and medical experts. These reports have brought back the haunted memories of the incident.

According to the four page reports, the alleged terrorists suffered injuries by a blunt object apart from gunshot wounds. Eight of the 10 bullet entries on the body of Atif are on the back side, in the region below the shoulders and at the back of the chest. The postmortem report of the other alleged militant Sajid reveals that two wounds on his body were not caused by a firearm. In technical language these injuries were ‘antemortem’ in nature. It implies that these caused before death.

The members of JSTA (Jamia Solidarity Teachers’s Association) is asking one relevant question:
I am sure Delhi Police would shed some light in due course of time about the report.

The various concepts of beauty!

Woman felt beauty came from within and was not a product one could buy. The modern women today are shaking off their old servitude.

THE ACTRESS, who fascinates and mesmerises us the most with her ravishing beauty is no other but our Piggy Chops – a seductress who has proved that beauty and brains can go hand in hand. She is an actress who has played the most number of roles in a single movie-12.

From here I want to transfer this discussion to a serious platform. When I talk about a predicate beauty, I feel like talking about subject beauty, and of course it is feminine beauty. When we define feminine beauty, we have to decide in which situation we would like to define it.

There had always been a co-relation between the women’s movement and lack there of, and society’s feelings about woman and their aesthetic appearance. Women emancipation movements have always been more concerned with gaining recognition of their equality than how they looked. Woman felt beauty came from within and was not a product one could buy. Women want to be loved. But they want it to be on a 50 / 50 basis which includes being admired for the qualities they possess.

The modern women today are shaking off their old servitude. Nafisa Ali had got her head shaved. Sushma Swaraj was going to push her head under the blade for some political challenge. Uma Bharti did it at times to please her deities. If they want to wear their heads shaven, as a symbol of defiance against the well respected and accepted concepts of beauty, they should and must always have their way.

Post World War II saw women being oppressed by the beauty industry. Women were subject to what society determined as beautiful. Exquisite movie stars were curvaceous and charming. A seemingly grand lifestyle was the ideal. Beauty publicists instructed women to follow their ideas and dictates. Marilyn Monroe was the most bleached and made up glamour girl of them.

These damsels were pressured to look beautiful at the expense of their health. They were made to believe in the Freudian sophistication, that they could desire no greater destiny then to glory in their own femininity. Experts told them how to catch a man and keep him, how to dress, look, and act more feminine and make marriage more exciting.

In 1968, woman protested the idea of themselves as sex objects. In Atlantic City women demonstrated against the 1968 Miss America Pageant. It was the first major action of the current woman’s movement; it was termed as anti-beauty than it truly was.

We Indians feel elated when one of our girls is recognized as a national and international celebrity. Maybe we have every right to do so. However, I would be prouder of an electric performance of Smita Patil, Deepti Naval, Shabana Azmi or Nandita Das than any of my sister or daughter showing off her vital statistics to unknown judges.

I loved Priyanka for her 12 performances. Following her foot steps Bipasha Basu is going to enact 9 different characters. Wow! Best of luck to all women including Bips!

Mayawati – a queer fish of Indian Politics

Mayawati

Mayawati is a strange phenomenon of emerging Indian politics. She is willing to rebel against any established norm of hitherto elite politics. She is going to write the new rules on her terms. I don’t approve the ostentatious display of garland of notes. However, countrymen are not unaware of the fact that its a mere flash in the pan of our political culture. What she accepted brazenly before a swarming crowd, our unscrupulous politicians practice behind close doors everyday. Let us be little more dispassionate of her politics and realize that she has not married. She has not to amass wealth for her progeny. Whatever she owns and bequeaths would go to the most trampled segment of society. She is working on the unfinished agenda of Gandhi and Baba Saheb Ambedkar. Granted that there is corruption in her set-up; granted that she flaunts her gifted wealth and granted that all she is doing is not correct. But, please let me know what other beholders of Indian values have done or doing.

A true film-making pioneer who has inspired dozens of filmmakers, Charlie Chaplin couldn’t resist the temptation of playing more than one role in his movies. Are you always happy

Those who commit suicide have their reasons to do it. They feel themselves at the precipice of an abyss. They sense humiliation and confusion about their future path and they get frustrated with the environment they live in.

SHAKESPEARE ONCE said – “How bitter it is to see happiness through another man’s eye.”

Suicide is the prelude to bitterness; suicide is associated with helplessness and depression. These emotions are compounded with sadness, anxiety and anger. Those who commit suicide have their reasons to do it. They feel themselves at the precipice of an abyss.

They sense humiliation and confusion about their future path and they get frustrated with the environment they live in. Sometimes they feel angry about their ethical, cultural and religious set up. They want to change everything and end up realizing that they can do almost nothing. Rejection is the first step towards total destruction.

Unhappy people avoid happy situations. A depressive individual is a perennial and contagious source of negative thoughts. These individuals are vulnerable to the mercenaries of death and destruction who maneuver and exploit their miserable situation in the name of spiritual ways to ultimate success.

On the contrary most of the happy people are easier to work with. Most of them are highly motivated and more willing to tackle a difficult project. They are more likely to be successful.

For a normal human being it is easy to equate with someone who is always up than someone who is always down. No one likes the company of the dour, morbid and morose. No one wants to work with a grump.

However, can anyone say for sure that happiness is a natural situation or can anyone control their own level of happiness?

An old friend was visiting a dying man. The man on the death bed said, “I’ve created a lot of confusion above-the-ground and now I’m going underground.” Even the grieving relatives couldn’t control the smile at the efficacious use of the word – underground.

“What is the hallmark of happiness?” The simple answer is – a sense of SUCCESS. A survey revealed that happy people appear to be more successful than their less-happy peers in three primary life domains – work, relationships and health. Happy moods appear to lead people to seek out others and to engage with the environment at large, to be more venturesome, more open and more sensitive to other individuals.”

Most people who are miserable seem eager to share their misery. But there is another breed of people who are chronically happy. They are insensitive to real situations. Often you find them laughing at funerals and making fun of those who flunk in exams. They pop up Colgate smiles near the intensive care units of hospitals.

Happiness is good but there is no royal road to the perfect life. There are times when nothing seems to work out right. Tides turn against a happy person also and to remain exultant and jovial in times of pathos is a sign of an unhealthy mind.

Rebellion brewing in BJP over Women’s Reservation Bill

Sometimes the left hand doesn’t know what the right hand is doing ; sometimes the government doesn’t know what the public is thinking; some times leaders do not know what the party men are thinking.

THE WOMEN’S Reservation Bill has exposed once again what a hollow pantomime this talk of ‘inner party democracy’ is all about. We did hear brilliant speeches of Arun Jaitly in Rajya Sabha and Swashma Swaraj in Lok Sabha. We were enlightened about the genuine hear felt concerns of BJP for the fair sex which is deprived of their due rights by the crooked creatures of earth the vile man ! These leaders were basking in the borrowed glory of Sonia Gandhi.

Today a very awkward and funny situation is developing in BJP as so many of its MPs are demonstrating open rebellion against the party’s plank. BJP never stops trumpeting the virtue of inner party democracy. What has happened in reality in this party was a blatant run of bleak dictatorship. The bosses of BJP thought that their dictats would be accepted by the party members with absolute submission.

Now listen what our dear Hukumdeo Narayan Yadav, senior leader and MP from Madhubani: “History will not spare the BJP. The BJP was like Bhishmapitamah and Dronacharya in Mahabharata who remained mute spectators to the disrobing of Draupadi. If they issue a whip (to vote in favor of the Bill), I will break it and vote against it. Let them end my membership, I am not bothered. I am a socialist and I cannot compromise on issues of social justice.”
He warned his party that BJP would “decline further” if it ignored the backward classes. and supported the bill.

Singing in the same tune the a senior leader in Lok Sabha today claimed “at least 70 per cent of MPs” were against the Bill while a senior BJP MP said he would defy any whip to vote in its favor even though his party had offered it “unequivocal support” in the Rajya Sabha.

Caught in Catch-22 situation top leaders of the party are assuring that grievances of the MPs will be taken into account,” Hukumdeo Narayan Yadav, senior leader and BJP MP from Madhubani in Bihar, declared he would defy any party whip in Lok Sabha and vote against the Bill.

The fiery Yogi Adityanath, MP from Gorakhpur in Uttar Pradesh is also airing his protest, wondering why the party had shown such eagerness to back the women’s reservation Bill when there were more pressing matters on hand.

As far as I am concerned, I don’t doubt the pious intentions of Sonia Ji who has pushed hard this bill. However, Women-Bill is not an innocent bill as it appears to a casual observer. Are we inviting a situation where in addition to 33% reservation, women will get some more seats from the general category and OBC/SC/ST category also with an extra of 20-30%.

The gross total would soar as high as nearly 60% or above. I wonder how Rajya Sabha accepted such important Bill without knowing any details. Congress has created the same brouhaha about different Commissions recommending the reservations of Muslims. Congress did never do anything except lip sympathy and garnering Muslim vote and support.

I accept that Indian women have traveled a long way from kitchen and fields to President House and Parliament; I agree that they must get their fair share. However, sometimes you suffocate or choke a cat with butter. Are we not going too fast ???

This best solution could have been a situation where there is no whip from any party. In all the august houses – Rajya Sabha, Lok Sabha and State Assemblies the members are allowed to vote according to their conscience. That will be the real representation of the will of the people.

Last but not the least, I would request Mamta Banerji and Yadav Trinity to stop playing the DIRGE of Muslim community. We are quite capable to take care of ourselves. We don’t need enemies if we have friends like you. Jai Ho !
